Bristol Aero Collection Trust is a registered company incorporated in England as a private company limited by guarantee under the Companies Acts (company number: 02689238), being a charity (registered charity number: 101632) and registered office address at The Clock Tower, 5 Farleigh Court, Old Weston Road, Flax Bourton, Bristol BS48 1UR.

BAC Trading Limited (company registration number 05078738) with registered office address at The Clock Tower, 5 Farleigh Court, Old Weston Road, Flax Bourton, Bristol BS48 1UR is a wholly owned subsidiary of Bristol Aero Collection Trust and performs the Trust's trading activities. All profits of the trading company are transferred to Bristol Aero Collection Trust, being a charity, under a gift aid declaration.

The VAT number of Bristol Aero Collection Trust is 138805594.

By offering to purchase Goods through the website www.aerospacebristol.org, you are entering into an agreement with BAC Trading Limited and/or Bristol Aero Collection Trust on the terms and conditions set out below. These terms and conditions of sale are additional to, and not a substitute for, the general terms of use of the website.

By placing an order with us, you warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.

These are the general terms and conditions of BAC Trading Limited and Bristol Aero Collection Trust governing your use of the Site:

1.    WHAT YOU ARE ALLOWED TO DO

Purchase Goods from BAC Trading Limited and/or Bristol Aero Collection Trust and/or Bristol Aero Collection Trust, provided you accept the outlined Terms of Sale, which will apply to any contract made between you and BAC Trading Limited’s online shop for the purchase and sale of Goods from the website.

Browse the online shop using a compatible web browser. Permission to browse the shop includes permission to make temporary or cached copies of parts of the shop to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the shop by you;

BAC Trading Limited provides these links for your convenience only and you use such links entirely at your own risk. We accept no responsibility for the content or use of such sites or information contained in them.

5.    SUSPENSION

BAC Trading Limited may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the shop from time to time. Access to or use of the shop or pages linked to it may be interrupted or contain errors. We reserve the right to make changes to our website, policies, and these Terms and Conditions of Purchase at any time. You will be subject to the policies and Terms and Conditions of Purchase in force at the time that you use the website or that you order Goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

6.    GENERAL

If you make a purchase online from the shop, we will send you an e-mail confirming receipt of your order and containing the details of your order. By placing an order you are offering to make a purchase subject to these terms and conditions. All orders are subject to availability and confirmation of the order price. Your order represents an offer to us to purchase a product which is accepted when we deliver the product(s) to you. The use of discount codes provided by BAC Trading Limited or Bristol Aero Collection Trust are to be used under our discretion and are for personal use only. Any items purchased are not to be sold for profit. BAC Trading Limited and Bristol Aero Collection Trust reserve the right to prevent any customer (s) suspected of using voucher codes and/or Goods to their own monetary benefit from making purchases.

7.    DESCRIPTION

We will take all reasonable care to ensure that all details, descriptions and prices of Goods appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

We reserve the right to make any changes in the specification necessary to comply with any applicable legal requirements and to change the specification published on the website provided that this does not materially affect the quality or performance of the Goods.

We warrant that we have the right to supply all Goods offered by us on the website and that any Goods purchased by you through our website are of satisfactory quality and reasonably fit for all the purposes for which the Goods are commonly supplied.

8.    AVAILABILITY AND PRICES OF GOODS

The supply of Goods from this website is subject to availability and it is not always possible for us to inform you at the time you place your order whether the Goods you want are still available for purchase. All Goods are offered for sale subject to availability. If we are unable to supply you with a product, for example if that product is no longer in stock or because of an error in pricing on our website, we will inform you of this by email and we will not process your order. If you have already paid for the Goods, we shall be entitled to cancel the contract between us and refund the full amount as soon as possible.

The price of the Goods shall be the price listed on the website on the date of your order (inclusive of VAT but exclusive of delivery charges which are payable by you). Prices are liable to change at any time, but changes will not affect orders which we have already sent to you.

9.    TERMS OF PAYMENT

All prices displayed on the website are quoted in UK pounds sterling and are inclusive of VAT at the current rate. All prices are correct at the time of entering information on the system and must be paid in full, including delivery charges. Payment for all Goods must be by credit or debit card. We accept payment with VISA, MasterCard, Electron, Delta and Maestro. (American Express is NOT accepted.).

All cardholders may be subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

If you are unable to complete your online order, please contact us by email to info@aerospacebristol.org and we will contact you to discuss this further.

Upon providing us with details of the payment card and submitting your order you:

  • confirm and undertake that the information contained within the order is true and accurate

  • authorise us to deduct from the payment card account the full price of Goods and all other payments which may become due to us under the Contract

Payment for the Goods and all applicable delivery charges is in advance.

The deduction of monies from your payment card does not mean that we have accepted your order nor does it mean that a contract has been formed between us. In the event that we reject your order we will credit your payment card with the amount deducted.

Where Goods are returned by you in accordance with your cancellation rights (below), we shall credit the payment card with the appropriate amount.

We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this website, unless this is solely due to our negligence.

Your order will only be dispatched once we have received confirmation of payment from Worldpay.

10.    DELIVERY

Shipping Terms:

All orders are dispatched within ten working days of receipt of the order, provided the item(s) is in stock. All items not in stock will be delivered within 28 days. Where this is not possible, we will refund your account using the same payment method as the original order. Please allow up to 28 days for delivery. We cannot be held liable for any delays in delivery due to unforeseen circumstances such as inclement weather, industrial disputes etc. or acts of third parties. We shall confirm each order in writing by sending you a printout of the order along with your Goods.

General Shipping Conditions:

Goods will be delivered to the address that you indicate on the order page and risk of damage to or loss of the Goods shall pass to you from the time of dispatch, even if the Goods have not been received by you in person.

11.    CANCELLATION AND RETURNS

Goods may be returned for a full refund (excluding delivery charges) up to 14 days from date of delivery of the Goods, or 7 days in the case of Goods purchased in a sale. Goods must be returned with its original packaging unused and undamaged. You shall be responsible for payment of the direct costs in returning the Goods to us.

A replacement product or full refund for the Goods will be given once Goods are received and inspected. No refund will be made in respect of delivery costs. Refunds will only be made to the payment card used to place the original order, and will be processed via our secure online shop. Please keep your proof of postage. This does not affect your statutory rights as a consumer.

If you do cancel a contract you must notify us in writing by email to info@aerospacebristol.org.

Damaged or Faulty Goods

Any claim by you which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall (whether or not delivery is refused by you) be notified to us within 28 days from the date of delivery or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If you do not notify us accordingly, you shall not be entitled to reject the Goods and we shall have no liability for such defect or failure, and you shall be bound to pay the price as if the Goods had been delivered in accordance with the Contract.

Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods is notified to us in accordance with these Conditions, we shall be entitled to replace the Goods (or the part in question) free of charge or, at our sole discretion, refund to you the price of the Goods (or a proportionate part of the price), but we shall have no further liability to you.

12.    WARRANTIES AND LIABILITIES

We only supply the Goods for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes and we have no liability to you for any business or trade losses, including (but without limitation) loss of profit, loss of business, loss of goodwill or injury to reputation or loss of business opportunity, subject to the following:

Notwithstanding any other provision in the Terms, nothing in these Terms shall:

  • affect or limit your rights as a consumer under English law or

  • exclude or limit our liability for death or personal injury resulting from our negligence

We reserve the right to refuse orders that we consider for any reason are for commercial purposes or subject to onward delivery by a third party.

Subject to the above, if we fail to comply with these Terms, we will under no circumstances whatever be liable to you for any loss of damage you suffer except to the extent those losses are a foreseeable result of our breach of these Terms or our negligence.

13.    BEYOND REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

14.    GOVERNING LAW AND JURISDICTION

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts. If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise enforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.
